Client Needs:
The Bangor Water District (District) is a quasi-municipal utility providing public drinking water and fire protection services to more than 45,000 people in the City of Bangor and surrounding communities in Maine. The District proposed to install a 75 KW generating unit, replacing the existing pressure-reducing valve that is used to dissipate energy prior to supply water entering the distribution system.
 
Kleinschmidt Solution:
The District utilized Kleinschmidt’s services in applying for and obtaining a small conduit exemption for the Project, which exempts it from requirements of Part I of the Federal Power Act (FPA). Exemptions are often granted through a more simplified process than a license and they are issued in perpetuity. Exempted projects are, however, subject to mandatory terms and conditions set by federal and state fish and wildlife agencies and by the Federal Energy Regulatory Commission (FERC). Kleinschmidt assisted the District to seek from FERC a formal determination on jurisdiction by submitting a Declaration of Intention, which included a detailed jurisdictional analysis. Although power produced is limited and is generated with water from a non-navigable waterway, FERC determined the Project to be jurisdictional. Kleinschmidt consulted directly with FERC to determine the necessary level of agency consultation and content requirements for the small conduit exemption application, and assisted the District with preparing the application and performing agency outreach.
 
Client Benefits:
Kleinschmidt assisted the District in navigating the complex federal regulatory process and obtaining the exemption, allowing it to install the turbine and sell the power generated by the unit to the local utility as a means to reduce overall operating expenses.
